Terms of Service

  1. User Agreement

  1. Definitions. Envision DGTL (hereinafter referred to as “we,” “us,” or “our”) is the principal entity managing our overall operations, including our creative media division. Envision Cloud, a sub-company of DGTL, is solely responsible for providing hosting services, related software, and support via our control panel, website(s), and other platforms, tools, and personnel (collectively, the “Services”). Individuals or organizations that purchase, access, or use our Services are referred to as “Customer,” “you,” or “your.” Any websites, applications, databases, or other digital assets created or managed by Customers through our Services are referred to as “ Projects.” A “User” is any employee, contractor, or individual associated with the Customer who has been granted access to the Services by the Customer.


  2. Governing Documents. These Terms of Service (“Terms”), together with our Service Level Agreement (“SLA”) and Data Processing Addendum (“DPA”), any documentation we provide (“Documentation”), and any signed quote, proposal, or order form between you and us (“Order Form”), form a binding legal agreement (“Agreement”). This Agreement becomes effective when you accept these Terms and complete the signup process.


  3. Authority. If you are entering into this Agreement on behalf of a company, business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the term "you" shall refer to such entity. If you do not have such authority, or if you do not agree with this Agreement, you must not accept this Agreement and may not use the Services.



  1. Provision of Services

  1. Service Provisioning. Envision Cloud will supply the Customer with the necessary credentials, security measures, and network access points (“Access Credentials”) required for the Customer and its authorized Users to connect to and utilize the Services as outlined. Access to the website or servers hosting the Services beyond the provided Access Credentials is prohibited. The Customer holds responsibility for managing and assigning User access through these credentials. The Customer may designate one or more Users as administrators or collaborators to oversee and manage the Services on the Customer's behalf. The Customer will be liable for all actions and omissions of its Users





  1. Account and Egilibity

  1. Account Creation. To use our Services, you must create an account by providing accurate and complete information during the registration process. All Users must be human. Accounts registered by “bots”, generic team accounts for sharing or other automated methods are not permitted. You are responsible for maintaining the confidentiality of your Access Credentials and for all activities that occur under your account.


  2. Eligibility.


  3. Account Security. You are responsible for securing your account and for maintaining the confidentiality of your Access Credentials. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not responsible for any loss or damage resulting from your failure to maintain the security of your account.


  4. Account Notifications. You agree that the email address you provide during account creation (“Email Address”) will be used for official notifications related to your Account and the Services. You are responsible for ensuring that email(s) from Envision Cloud successfully reaches your inbox and for updating your Email Address when necessary. Failure to read emails may negatively impact your use of the Services, and such impact will not be covered under the Service Level Agreement (SLA).


  5. Account Termination. Envision Cloud reserves the right, in its sole discretion, to suspend or terminate your account if it determines that: (i) you have violated any provision of this Agreement; or (ii) you have engaged in any activity that may compromise the integrity of our Services or illegal activities as outlined in Section 2, paragraph b.



  1. Customer Content

  1. Definitions. "Customer Content" or "Content" refer to all materials—including text, data, code, software, designs, images, media files, logos, and any other content—that you upload, post, transmit, store, or otherwise process in connection with the Services. You are solely responsible for all such Content, including its design, development, modification, and maintenance, as well as for ensuring its proper migration should you choose to host it with another provider. Customer alone is responsible for any of the Content that may be lost or unrecoverable through the Customer’s use of the Services. Customer is encouraged to archive its Content regularly and frequently.


  2. Ownership. You retain all rights, title, and interest in your Customer Content. It is your responsibility to provide this Content in a form that requires no further processing or modification by Us.


  3. License. By submitting or otherwise posting Your Content through the Services, you grant Envision Cloud a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to access, use, copy, modify, reproduce, distribute, display, publish, store, perform, translate, and create derivative works from Your Content. This license is granted solely for the purpose of delivering and securing the Services, including protecting against fraud, malware, viruses, or other harmful elements.


  4. Restrictions. The Customer agrees that any Content displayed through the Services will not violate any applicable laws or infringe upon any third-party rights, including intellectual property, publicity, or privacy rights. The Customer further agrees not to authorize itself or any User to engage in any activity that infringes upon these rights, limited but not limited to:

(a) is used in a way that could be detrimental to the reputation of Envision Cloud;

(b) implies or suggests that the Content is created or endorsed by Envision Cloud;

(c) may create a risk of harm, loss, damage, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, to any animal or to any property;

(d) may constitute or contribute to a crime or tort;

(e) Contains any information or content that is deemed to be unlawful, illegal, harmful, abusive, racially or ethnically offensive, defamatory, infringing, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable by us;

(f) may seek to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;

(g) includes any information or content to which the Customer or User has not obtained any necessary rights or permissions to use accordingly or to make available under any law or under contractual or fiduciary relationships;


  1. Content Removal. Envision Cloud reserves the right, but is not obligated, to reject and/or remove any User Content that we believe, in its sole discretion, violates the Agreement. Should your Content or its use be restricted, you or any notifying third party may contact us through our support portal to request a review of our decision.



  1. Payment, Subscriptions and Fees

  1. Payment Terms. Customer agrees to pay all fees due under this Agreement in full, without offset or deduction, using a valid payment method. Unless otherwise specified, all fees are due within thirty (30) days from the date of invoice, are non-cancelable and non-refundable, and must be paid in EUR (Euro). All amounts are exclusive of applicable sales, use, value-added, or other taxes, which shall be the sole responsibility of the Customer. Customer shall remain fully liable for all fees related to the Services, including where the Services are used on behalf of third-party clients, regardless of whether such third parties make payment to the Customer. Envision Cloud reserves the right to suspend or terminate the Customer’s account for failure to pay fees when due, disputed charges, or chargebacks


  2. Merchant. All payment transactions are processed through our third-party payment provider, Mollie B.V. ("Mollie"). Mollie is responsible for handling payment processing, issuing invoices, and responding to any customer service inquiries related to billing or transactions. By using the Services, the Customer agrees to comply with Mollie's applicable terms and policies


  3. Recurring Payments. By selecting a pricing plan, the Customer acknowledges that the Services involve recurring charges and accepts full responsibility for all ongoing payment obligations, including any applicable taxes or additional charges. We (or Mollie) will automatically bill the Customer based on the billing cycle of their selected subscription plan (e.g., monthly or annually) until the Customer cancels the Services in accordance with this Agreement. It is the Customer’s responsibility to ensure that payment information remains accurate and up to date.


  4. Modification. Envision Cloud reserves the right to modify its fees, provided that notice will be given to the Customer prior to any such changes
